General:

  • For safety reasons, your products must be installed by qualified persons.
  • Return shipping costs are at the buyer’s expense. For warranty and damage cases you can request a return label.
  • Your online purchase can be returned up to14 days after delivery, providing it is unused and undamaged. Return to our Postal address. Upon receipt we will give you a refund for your order within 14 days, minus shipping costs.
  • Electronic components such as controllers, relays and alternators cannot be returned if they have been connected.
  • We cannot accept any liability for typing errors, price or product changes.

Used articles/engines:

  • The following additional conditions apply to the purchase agreement for used articles:
  • The buyer has a 14-day cooling-off period after concluding the purchase agreement.
  • The buyer has a 12-month warranty on the engine components. This warranty means that if engine components fail within 12 months after concluding the purchase agreement, without fault or negligence of the buyer or third parties, and need to be replaced, these components will be repaired or supplied free of charge by the seller.
  • This warranty does not apply if the seller explicitly states prior to or during the purchase that the engine and/or its components are defective, or if the seller explicitly declares the warranty not applicable prior to or during the purchase.
  • All work carried out by the seller, regardless of whether it concerns assignment, service, or otherwise, takes place at the seller’s workshop. The buyer is responsible for the transport of the engine to and from the seller.
  • The seller shall never be liable for any damage other than damage to the engine itself.

Contract Clause – Export Control & Sanctions

AB Marine Service actively screens persons, companies and entities against international sanctions lists. For export transactions, the Customer may be required to sign an End-Use Certificate (EUC) confirming the end use, end user and final destination of the goods.

1. Applicable Regulations

The Parties acknowledge that the supply, transfer, re-export, transit, technical assistance, services and financial transactions under this Contract may be subject to EU export control legislation, including Regulation (EU) 2021/821 (dual-use), and to EU, UN, OFAC and national sanctions regimes.

2. Compliance Obligation
Each Party guarantees that it:
a. complies with all applicable export control and sanctions regulations;
b. does not supply goods, software, technology or services to countries, entities or persons subject to an embargo or sanctions regime;
c. does not engage in transactions that are directly or indirectly prohibited or constitute circumvention of sanctions.

3. Prohibited End Use and End Users
The Customer guarantees that the goods, software, technology or services supplied:
a. will not be used for military purposes, weapons of mass destruction or other prohibited end uses;
b. will not be supplied to end users listed on a sanctions list or located in a sanctioned country;
c. will not be re-exported without compliance with all applicable export control and sanctions regulations.

4. Licenses
If an export or other license is required for the performance of this Contract, the obligation to deliver shall only arise after the relevant license has been obtained. AB Marine Service shall not be liable for delay or non-delivery resulting from the absence or withdrawal of such license.

5. Information and Cooperation Obligation
The Customer shall provide, upon request, all information necessary for classification, screening, license applications and compliance, including:
– end-user declarations
– information on end use
– information on re-export or transit.

6. Suspension and Termination
AB Marine Service may immediately suspend or terminate the performance of this Contract if:
a. there is reasonable suspicion that a transaction violates export control or sanctions regulations;
b. new sanctions or regulations prohibit the performance in whole or in part.

In such case, the Customer shall not be entitled to any compensation.

7. Indemnification
The Customer shall indemnify AB Marine Service against all damages, fines, costs and claims arising from a breach of this clause by the Customer or by parties to whom the Customer supplies the goods or services.
